By accessing or using KinkyGay, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. You must be 18 years of age or older to use this website.

KinkyGay is an open-source platform for creating and interacting with AI characters. We provide tools and services for users to develop, share, and engage with AI-powered characters.

3. User Accounts

You may need to create an account to use some features of our service. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. User Content and Moderation

You retain ownership of any content you create or upload to KinkyGay. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and distribute your content in connection with our services.

Users are solely responsible for all content they generate, share, or upload to the platform. We reserve the right to manually review flagged content and suspend or terminate accounts if needed to uphold our community standards.

Public pornographic content is strictly prohibited, including but not limited to explicit images, genitalia photos, or sexually explicit material.

5. Prohibited Content

The following types of content are strictly prohibited:

  • Content that violates laws or regulations, including promotion of illegal activities, drugs, weapons, or violence
  • Child exploitation or pornographic content of any kind
  • Content that infringes on privacy, intellectual property, or other rights without consent
  • Content that glorifies or promotes self-harm
  • Misinformation, conspiracy theories, or unethical advice that could cause harm
  • Spam, phishing attempts, malware, or other malicious activities
  • Content promoting criminal activity or the sale of illegal substances
  • Content that infringes on third-party intellectual property rights

6. Payment and Refund Policy

No Refunds: All payments for subscriptions and credits are final and non-refundable. By making a payment, you acknowledge that you understand and agree to this no-refund policy.

Duplicate Payments: In the event of duplicate payments caused by user actions (including but not limited to multiple clicks, network issues, or user error), the responsibility and consequences of such duplicate payments shall be borne entirely by the user. We are not liable for any duplicate charges resulting from user operations.

Subscription Cancellation: You may cancel your subscription at any time through your account settings or by contacting us, but you will not receive a refund for any unused portion of your current billing period. Your subscription will remain active until the end of your current billing cycle.

Credit Usage: All purchased credits are non-refundable and non-transferable. Credits do not expire but cannot be refunded once purchased. Credits are consumed when you use our services and cannot be restored or refunded.

Payment Processing: All payments are processed securely through third-party payment processors. We do not store your payment information on our servers.

Price Changes: We reserve the right to modify our pricing at any time. Price changes will not affect existing subscriptions until the next billing cycle.

7. Intellectual Property

The KinkyGay platform, including its original content and the compilation of all content, is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Termination

We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

9. Disclaimer of Warranties

KinkyGay is provided as is without any warranties, expressed or implied. We do not warrant that the service will be uninterrupted or error-free.

10. Limitation of Liability

KinkyGay shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use the service.

11. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. Your continued use of the service after any changes constitute acceptance of those changes.
